Puppy Purchase Agreement
A. To the best of
my knowledge, said puppy/dog is in healthy and sound condition at the time
of sale. Buyer has 72 hours from the time of delivery/pickup to have a vet
check done on said puppy. Vet check must be done by a licensed
veterinarian. Buyer is required to have a licensed veterinarian administer
two more puppy vaccines to said puppy. Parvo and distemper vaccines must be
given at two-four week intervals following first vaccines given by breeder.
If buyer fails to have vet check done within 72 hours or fails to continue
vaccines as stated above, the parties agree that any guarantee will be
considered null and void. Keep shot records from your vet. Along with
yearly vaccinations being kept up we require that your puppy be kept on
Nuvet for 2 full years in order to extend the guarantee of your puppy to 2
years of age.
B. All puppies/dogs
are sold as PET QUALITY only, this does not mean they are, or are not
show/breed quality. This does not mean they are not show/breed quality. No
restrictions are put on my puppies unless otherwise discussed. I just ask
if you breed that you do so responsibly. Do this at your own risk.
Complications can arise and I will not be responsible. Not all dogs are
capable of having puppies. This is not something we can know when
evaluating an 8 week old puppy. This is not covered even if you buy a dog
with the intention of breeding. The breeder is only liable to the extent
stated in this contract.
1. If you are buying a male with the intention to breed, I do not guarantee him to have viable semen, I do not guarantee him to actually breed. If you buy a puppy that needs to be shipped my vet will make sure both testicles are there. (The testicles may not be completely dropped at 8 weeks). If puppy is being picked up and you are wanting to breed, I recommend asking for a vet check before you pick him up to make sure the testicles are where they are supposed to be. If he is an adult, we’ll make sure both testicles have descended before he leaves. When you buy a dog to breed, you take a chance just like we all do. Please understand I’m just being upfront. I do not replace dogs once they have left for testicles or lack of. 2. There is no warranty against bad bites. When the puppy leaves, if it is being purchased as a possible breeding dog, we well make sure it has a scissor bite. Bites can sometimes change. All I can guarantee is that it is a correct scissor bite when the puppy leaves at 8 weeks. By request, this can be checked and noted by a vet as well. C. Health guarantee
does not cover any parasite, internal or external as this is a treatable
condition.
D. Seller can not be
responsible for Hypoglycemia (low blood sugar) or the effects of any stress
related illness due to travel/rehoming. Buyer must make certain that their
new puppy eats and gets plenty of rest. You can find info on Hypoglycemia

E. Only
untreatable, genetic diseases or defects will be considered. Each case is
dealt with individually.
F. A dog will not be
replaced if it has been altered or bred.
G. Puppies are sold as the color they appear to be. H. We do not cover any testing of any kind unless it is done before the puppy/dog is purchased.
As the seller, I
understand that the typical puppy buyer is not necessarily as experienced
with raising puppies as I am. (I have lots of practice) If there is any
concern at any time with your puppy, please call right away for tips and
advice. Sometimes I can save un-needed trips to the vet. I am always happy
to share knowledge and advice on my dogs. It is better to call about a
concern that turns out to be nothing than to not call and wish you had.

Seller is in no way
responsible for any vet bills made after puppy/dog leaves the care of
Lindsey’s Aussies/Porter Horses. In the event that a problem should arise
with said puppy, buyer should contact seller immediately. Each case is
dealt with individually as every situation is different. Seller will not
refund money in any situation. Shipping is always the responsibility of the
buyer, even in the event a puppy is to be sent back and/or replaced. Any
and all vet bills are the responsibility of the buyer. NO exceptions.
All shipping costs
related to any dog being purchased, as well as in relationship to any dog
being replaced for any reason, are the responsibility of the buyer. Seller
shall not be responsible for death of said puppy/dog due to negligence or
carelessness of any airline or other live animal carrier, it's agents or
employees, or the buyer.
Any money placed on
a puppy is non-refundable and non-transferable for any reason.
Our health guarantee
becomes null and void if we do not have records of your dog being kept on
NuVet for at least the first 2 years of their life. It is also null and void
if the dog is bred before 2 years of age for a female and 1 year of age for
a male. This period is critical for their development and long term health.
Most of my dogs are
sold with full registration with ASDR. This gives full breeding rights to
the buyer. If the buyer is buying a puppy/dog to breed.
Lindsey’s Aussies is
not responsible for any conclusive genetic testing of any kind.

Lindsey's
Aussies/Porter Horses primary objective is to breed genetically sound Toy
Australian Shepherds, but genetics are only part of raising a healthy, sound
Aussie. Another large component is nutrition. Dog foods on the market
cannot be relied upon solely to meet your dog’s nutritional requirements.
Poor nutrition can be attributed to a number of health issues.
This said, we

This contract is
under the jurisdiction of the state of Oklahoma. In the event of any
dispute, the parties mutually agree that the dispute will be settled under
the jurisdiction of Comanche County, Oklahoma.
All parties mutually agree that all lawyer fees shall be paid by the buyer.
In the event that a
court of law finds any part of this agreement unenforceable, all remaining
provisions not deemed unenforceable will be enforced to the full extent of
the law.
This agreement sets
forth the entire agreement between parties. This agreement may not be
changed, altered or amended except in a writing signed by both parties.
